Terms of Service

1. Acceptance of Terms

By accessing or using Trivecta® ("the Service"), operated by OSUMA arkkitehdit Oy (business ID / Y-tunnus: 2362162-7; "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Trivecta is a cloud-based platform for architectural visualization using AI-powered image and video generation, node-based workflows, and asset management. The Service is designed for architecture professionals and studios.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain more than one free account.

4. Credits and Billing

• The Service uses a credit-based system. Free accounts receive 500 starting credits.
• Credits are consumed when using AI generation features (image, video, upscale, etc.).
• Credit costs vary by model, resolution, and operation type. Current rates are displayed before each operation.
• Purchased credits are non-refundable except as required by applicable law or in the case of a verified technical failure on our side.
• Unused credits do not roll over and expire at the end of the billing period.
• We reserve the right to adjust credit pricing with at least 30 days' notice.

5. Acceptable Use

You agree not to:

• Use the Service to generate illegal, harmful, or abusive content.
• Attempt to circumvent rate limits, credit systems, or security measures.
• Use automated tools to access the Service without our permission.
• Share your account credentials with others.
• Use disposable or temporary email addresses to create multiple accounts.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.

Ethical use of AI

The AI features are a design and visualization aid. When using them, you agree not to:

• Create deepfakes or impersonate real, identifiable people, brands, or organizations without their consent.
• Misrepresent AI-generated content as a photograph of a real, built project, or otherwise present it deceptively where doing so could mislead clients, juries, authorities, or the public. Disclose that visuals are AI-generated where accuracy or honesty is expected (e.g. competition entries, permits, marketing).
• Infringe third-party intellectual property, trademarks, or the protected style of living artists, or generate content that is defamatory, discriminatory, or harmful to identifiable individuals.
• Violate the acceptable-use policies of the underlying AI providers (fal.ai, Together.ai, Google Cloud / Vertex AI, KIE.ai), which apply in addition to these Terms.

You remain responsible for how AI-generated outputs are used, for verifying them, and for complying with the professional, contractual, and legal obligations that apply to your work.

6. Content Ownership

• Your content: You retain ownership of the prompts, input images, and project data you provide. You grant us a limited license to process this content solely to provide the Service.
• Generated content: AI-generated images and videos created through the Service are yours to use for commercial and non-commercial purposes, subject to the terms of the underlying AI model providers.
• Our content: The Service, its design, code, and branding remain our intellectual property.

7. AI-Generated Content

Content generated by AI models may not always be accurate, appropriate, or suitable for your needs. You are responsible for reviewing and validating all generated content before use. We do not guarantee that generated content is free from errors, biases, or intellectual property concerns.

Quantity takeoff (QTO) reports, property data, and any measurements derived from IFC or BIM models are AI-generated estimates, not certified documents, and are not a substitute for professional quantity surveying. You must verify all quantities independently before relying on them for construction budgets, permits, or contractual purposes. OSUMA arkkitehdit Oy is not liable for any decisions made on the basis of AI-generated outputs.

Model availability.The AI models offered in the Service are curated by us — we select the models we consider best suited to the platform. The available models may change at any time: a model may be added, replaced, deprecated, or removed, and its behaviour, quality, or credit cost may change, depending on our third-party providers' availability, terms, or decision to discontinue it. We do not guarantee the continued availability of any specific model, and a workflow that relies on a particular model may need to be updated if that model changes or is removed.

8. AI Data Processing

To generate content, the prompts, images, and IFC model data you submit are transmitted to third-party AI service providers for processing, including:

• fal.ai (image generation)
• Together.ai (language models)
• Google Cloud / Vertex AI (video and vision)
• KIE.ai (video generation proxy)

These providers process your content solely to generate the requested output. Together.ai and Google Cloud have confirmed that they do not use API customer data to train their models; we are seeking the same confirmation from fal.ai and KIE.ai. See our Privacy Policy for full details.

9. Beta Disclaimer

• The Service is in beta. Features may change, break, or be removed without notice.
• Data loss is possible during beta. Export your work regularly.
• No Service Level Agreement (SLA) applies during the beta period.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, OSUMA arkkitehdit Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We retain your data for 30 days after termination, after which it is permanently deleted. We may retain anonymized data as described in our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Helsinki, Finland.
